CARPET

At Nodi Rugs our focus is on hand made, individual items, being both a handmade and natural product some variation in colour and size will occur. The below variation can occur - These are not considered flaws but part of the nature of a hand crafted product:

  • Each rug is hand dyed at the time of production and variance between samples and products will occur, although our artisans take every measure to ensure accurate colour matching, a slight variation may occur from dye lot to dye lot.
  • As our products are handmade it is impossible to achieve an exact size and can vary between +/- 5%, this is considered normal and acceptable.
  • Natural rugs will fade in the sun, please beware of this when you are placing your rug in a room. We suggest applying MicroSeal to decrease the fading and rotating your rug often for even colour fade.
  • Any shedding with all natural fibres is to be expected, the rug will most likely shed in the initial stages of its life, this is a characteristic of the fibre and will settle over time and is not a fault.
  • Pilling can occur due to traffic, moving furniture, vacuuming or other mechanical agitation. This can be trimmed with scissors.
  • Pop ups: due to the type of weaving, there can be short fibres popping up while the rug settles. This can be trimmed or pushed through.

Warranty: Nodi Rugs are handmade and are therefore unable to have an unconditional warranty. However, we will repair or replace any rug if it is defective during the 12 months from the date of purchase provided the rug was used for normal household purposes and maintained in accordance with the care instructions. Any improper or negligent use/ storage will void this warranty. The warranty applies to household residential use only and not to any commercial, contract, rental, trade, institutional or other non-residential use. If you wish to make a claim under this warranty, you must provide photographic evidence to support your claim along with your order number and designer name if this is applicable.

Once your order has been delivered or you have collected it, Nodi is no longer responsible for the condition of the rug and any improper storage.

Sales Items: No returns, refunds or exchanges on any sale products. Nodi's standard 12 month warranty does not apply to these items. Please note that our terms on change of mind do not apply to archive or sale rugs.

Change of Mind: We aim to depict items and images on our website as true as possible to the products but cannot guarantee every device will accurately depict the actual colour of the merchandise. To help with your decision making, we do offer samples, in home design consultations and appro on all our rugs (Auckland only) and if you live outside Auckland we can use our Visualiser tool for you to virtually see one of our rugs in your space – if you are still unsure and require further help please call our showroom and one of our design consultants will be able to help (09) 390 0370.

We do not offer a refund if you change your mind on a particular purchase, however we will offer a credit for the value of your purchase. In the event that you change your mind on your purchase, a Nodi representative needs to be contacted within 30 days of the item being delivered.

A restocking fee of $350 is payable for change of mind. You are also responsible for covering the cost of the return shipping back to our Auckland warehouse. Return shipping costs will be quoted at the time of the change of mind and will be charged and paid prior to the rug being collected.

Upon Nodi warehouse receiving the unwanted returned rug, our team will inspect the rug for any damages and ensure it is in sellable condition. If sellable condition is confirmed a credit note minus the restocking fee will be issued. Shipping costs will apply for any new purchases. Note we will not issue a credit if the returned rug arrives damaged due to neglect or mistreatment by the customer.

Please note that our terms on change of mind do not apply to archive, sale or custom rugs or carpets.

A change of mind on entrance mats will only be accepted if the mat is in saleable condition with original jute sack packaging. Customer is responsible for return shipping charges to our Auckland showroom. 

Custom Orders: We do not exchange, refund or accept returns for change of mind on custom orders, unless proven faulty as these have been made to order especially for you.

Current lead times including shipping for our container shipments is 15 weeks from our order cut off date, these are subject to change without notice – you will be advised at the time of purchase the current expected delivery date. Please email hello@nodi.co.nz  for any information on our container cut off and delivery dates. For custom orders choosing Air Freight, the current lead time including shipping is 12 weeks.

Note, due to the hand knotted nature of our Hand Knotted Jute rugs this style has a longer production lead time than our other styles. For custom orders please email hello@nodi.co.nz  for more information on this style and current lead time.

All shipping dates are provided according to our buyplan, any manufacturing and/or shipping delays are beyond our control we therefore cannot commit to any arrival dates until we have the product in our Auckland warehouse. We will update you on ETA’s to the best of our ability with the information provided from our manufacturer and shipping partners.

For custom orders, a 50% deposit is required in order to commence production, the 50% balance is to be paid in full once items have been received into our warehouse. If you are not ready to receive your order once it is available to be dispatched from our warehouse, we still require the final payment in full to hold your order and storage fees will apply. Storage fees for rugs is $9.65 per week and is subject to change without notice. This deposit is non refundable for change of mind or cancelled orders. Received deposit payments are treated as acceptance of Nodi Handmade Rugs Terms and Conditions.

For all custom orders that are ordered from a sample, it must be noted each rug is hand dyed at the time of production and variance between samples and products will occur. Although our artisans take every measure to ensure accurate colour matching, a slight variation may occur from dye lot to dye lot. Being a handmade item there will be some variation in colour and size - these are not flaws but part of the nature of a handmade product. A +/- 5% size variation is considered normal and acceptable. We do not offer any return or refunds due to colour variations from samples and/or size variations within the 5% tolerance. We respect our right under consumer law not to offer refunds on any orders delayed by natural disasters, national or global pandemics or production and shipping delays. These are not grounds for refunds under any circumstances as they are ultimately beyond our control. 

Underlay and MicroSeal: MicroSeal is applied prior to delivery. This service can be arranged on your behalf, any issues arising with the parties are to be raised directly with the third party company.

Underlay is supplied separately from your rug from our third party supplier.

Nodi takes no responsibility for any services related to third party companies such as couriers and MicroSeal New Zealand.

Delivery: We deliver within Auckland on a Tuesday and Thursday between 8am-1pm each week. We will contact you with confirmation of your delivery day via email and our carrier will call you to confirm the night before. We do offer a timed delivery and installation service for an additional cost. Please contact us for details. This service is only available in the Auckland area currently.

Auckland deliveries are delivered and carried inside your house to required room only, rural and nationwide deliveries are sent via freight which means only one driver delivers to your driveway only. Someone will need to be on the other end to help unload.

North Island

3-7 working days if placed before 1pm NZT on any working day.

South Island

4-10 working days if placed before 1pm NZT on any working day.

Our carriers cannot confirm an exact time/day for delivery. We can mark delivery requests provided by you on your item(s) but we cannot guarantee the person making the delivery will be able to comply. Deliveries take place Monday to Friday. Once the carrier has picked up your order, you’ll be emailed a tracking number so that you can follow the journey of your item(s).

Delivery is deemed to be effective when the delivery company receives a signed receipt or delivery docket confirming that the goods were received. If the packaging is damaged, please do not sign the delivery docket and contact us immediately.

If you wish to make any changes to your delivery date after your order has been picked and dispatched, this will result in a restocking fee of $350.

Installation: Installation within Auckland can be arranged for an additional installation fee. Please email hello@nodi.co.nz  for more information.

Storage: If you are unable to receive your order Nodi is able to store your order at our Auckland warehouse for a weekly storage charge of $11 per rug. This charge will be invoiced monthly for the full extent of the storage period. Storage invoices are payable within 7 days. Any overdue invoices will be subject to a weekly 5% interest fee.

Expected Delivery Date: An expected delivery date will be agreed between you and your sales rep at the beginning of your order process. This agreed date is the point of reference for all other timings of Nodi's terms and conditions.

If your order is unable to be dispatched at the agreed dispatch date due to your own delays, Nodi can hold your order for a fee that will be charged out monthly and the order itself needs to be paid in full by the original dispatch date. For full storage fees and terms please read the above. For orders over the value of $20,000, please ensure you read the terms under invoicing and late payments.

Pricing or Website Error: If an item is advertised for sale at a particular price either on the Nodi rugs website or in store, Nodi Rugs reserves the right to advise you, our customer, that an error has been made and the price is incorrectly advertised. We do not have to sell the item for the advertised price in the event that it is a genuine mistake. This is in compliance with the Fair Trading Act 1986. The Act protects the consumer against being misled or treated unfairly by retailers. It also protects retailers when genuine mistakes occur with pricing errors.

Invoicing and Late Payments: Orders at the value of $20,000 and above are subject to a monthly late fee of 5% of the value of your order. This late fee will be applied, if the final payment of your order is not paid within 7 days of the invoice being issued.

Final payments are required prior to dispatch as well as when an order is needing to be held past the agreed expected delivery date.

Orders will not be stored without first being paid in full. Only items with at least a 50% deposit payment made against them are secured and placed on hold to an order. Nodi offers a 1 weeks grace period for payment to be made against an order initially before items are again available to be sold. After the grace period Nodi is not responsibility if items are sold or go out of stock prior to payment being made.

For the purposes of these terms of sale, the following definitions shall apply:

  • NODI means NODI Handmade Rugs Limited.
  • Customer or You means the individual, company, or other entity that purchases goods or services from NODI and includes any person acting on behalf of or with the authority of the customer.
  • Goods means all carpet, materials or other items provided by NODI, including any associated services such as installation, delivery, and consultation. For clarity, these terms do not apply to the sale of rug products from NODI.
  • Services means the labour, installation or other professional services provided by NODI in relation to the goods.
  • Price means the total price paid by you for the goods and services, including any additional costs such as freight, insurance, and GST. 
Any goods and services supplied by NODI to the customer will be supplied on these terms only. The only circumstance where any variation to these terms will apply is where NODI has expressly agreed in writing to the variation.

1. Standard Exclusions: Unless agreed upon in writing in your quotation, carpet installation excludes: 

  • floor preparation, including but not limited to floor levelling and door trimming, and
  • removal of carpet, furniture, appliances, or other items from the site, and
  • installation of carpet under joinery units.

2. Quote Acceptance

  1. Quotes are valid for 30 days from the date of issue.
  2. Quotes include all supplied details to NODI, any extra goods or services included in the quote are clearly noted. Any missing details or requirements should be notified to your NODI representative so that an amended quote can be supplied.
  3. By accepting the quote, you are accepting that the goods and services in the quote are correct, and you are agreeing to our terms and conditions of sale.
  4. Acceptance of the quote does not secure your order; orders are secured once the deposit payment has been received by NODI within 7 days of quote acceptance.
  5. NODI reserves the right to withdraw its quote at any time before acceptance.
  6. If goods are required in addition to the quotation, you agree to pay any additional cost. 7. By accepting the quote, you acknowledge that a delay in payments may affect the agreed delivery and installation schedule.

3. Pricing Changes

  1. You accept that pricing in our quotation is subject to change based on final site visits and measurements or where additional goods or services are required to complete the installation. 
  2. If you request a variation in the goods or services agreed, we will act reasonably to consider and accommodate your request.
  3. Any onsite delays created by a third party may require an extended installation period, which may incur further charges.
  4. Any variations to the goods, services or price will be communicated to you and variations will not commence until both parties have agreed in writing to the changes and, if required, further payment has been received to cover the change(s). 

4. Pricing & Payment

  1. Unless otherwise agreed:
    • Pricing on quotes is valid for 30 days from issue.
    • A 50% deposit is required to secure your order. Payment details will be shared once you have accepted the quote.
    • Balance of payments are due in full prior to delivery and installation.
    • Any additional charges that are incurred must be paid immediately upon invoice for work to continue.
  2. If any amount remains unpaid seven working days after completion, NODI may charge interest on the sum owed at a rate of 5% per month, calculated on a simple interest basis.
  3. Any expenses incurred by NODI in collection of the sums due (including filing fees, legal fees on an actual solicitor/client basis, or debt collection agency fees) will be payable by you. 
  4. If no price has been stated in writing or verbally agreed to, the goods will be deemed to be sold at the current amount charged by NODI. The price may be increased by the amount of any reasonable increase in the cost of supply that is beyond the reasonable control of NODI. 
  5. If a dispute over payment arises, the customer will notify NODI in writing within 7 days of receipt of the invoice, detailing the reasons for the dispute. Any undisputed portion of the invoice must still be paid within the original terms while the dispute is being resolved.

5. Customer Responsibilities: The customer is responsible for ensuring that the site is ready for installation on the date agreed with NODI. Unless expressly agreed otherwise, this includes: 

  • Floor levelling, and 
  • Ensuring other trades have completed work prior to the installation date, including trimming doors in preparation for carpet installation, and 
  • Removing any existing floor covering, furniture, appliances, and other objects from the installation site, and 
  • Ease of access to site, and 
  • Paint cure time. Any new paint that has not been allowed to cure for a minimum of 28 days (weather dependent) is prone to scuffing and scratching during carpet installation. This may require touching up by other trades after the installation is complete. NODI will not be held responsible for any scuffing or damage caused by carpet installation if paint is not properly cured, and 
  • Eradication of any existing insect infestation and prevention measures to treat floors prior to installation. 

6. Lead Times & Delivery

  1. Estimated lead times for delivery or installation will be provided at the time of order. These lead times are subject to change. Any changes to the lead time will be communicated to you as soon as possible. NODI is not responsible for any delays caused by factors beyond its control, including but not limited to supply chain disruptions, shipping delays, or weather conditions.
  2. Delivery will be made to the address outlined in the sales order.
  3. You agree that if we fail to deliver on time, you will not be entitled to cancel this agreement. NODI will endeavour to deliver to the schedule agreed and any delays will be promptly notified to the site representative.
  4. If you are unavailable or unable to accept the goods within the agreed timeframe of delivery, you accept we can charge you a reasonable fee for storage, per the Additional Charges Schedule.
  5. While NODI will endeavour to meet the agreed delivery schedule, it is not liable for delays caused by factors outside of its control, including but not limited to weather conditions, transport disruptions, or third-party delays.

7. Acceptance

  1. You are deemed to have accepted the goods upon installation, unless you notify NODI in writing within 7 days of installation or delivery (whichever is later) that the goods are damaged or defective. 

8. Cancellation

  1. Custom product orders
    • Deposits on custom products are non-refundable once the order has been committed to production.
  2. Standard product orders
    • Orders may be cancelled with no penalty if pick, pack, and dispatch from the NODI warehouse has not commenced.
  3. All cancelled orders
    • If goods have been shipped, all return freight costs to NODI are the responsibility of the customer.
    • If goods have been shipped or prepared for shipment, a restocking fee will be charged at a rate of 25% of the order value.
  4. Refunds will be issued in line with the above cancellation policies and only after applicable restocking, deposit and other charges have been deducted. 

9. Warranty & Defects

  1. NODI carpets are covered by a 5-year manufacturing defect warranty, subject to the full terms and conditions outlined in our Nodi Carpet Warranty. This warranty applies to the original purchaser and the installation site only.
  2. Any defects or issues must be reported in writing within 7 days of discovery.
  3. This warranty does not cover damage caused by improper installation, wear and tear, exposure to sunlight, or damage due to improper use or maintenance.

10. Suspension and Termination: NODI has the right to suspend this contract if any event of default occurs, but this will not prejudice NODI's right to claim for money due as at the date of such cancellation.

11. Guarantee and Personal Obligation: If you are a company or a trust, then in consideration of NODI accepting this contract, you also sign this contract in your personal capacity, and you jointly and severally guarantee the performance of the customer hereunder, and you sign as a principal obligor.

12. Assignment and Force Majeure

  1. Assignment of Rights: You cannot assign your rights hereunder without the prior written consent of NODI. 
  2. Force Majeure: NODI will not be liable to perform its obligations hereunder if the failure is due to events beyond its control, including but not limited to pandemics, government regulations or acts of God. 
  3. Non-Waiver of Rights: Failure by NODI to enforce any of its rights or remedies under these terms at any time shall not be deemed a waiver of those rights or remedies. NODI retains the right to enforce its rights and remedies at any time, despite any delay or omission in exercising them.
  4. Severability: If any provision of these terms is deemed to be invalid or unenforceable, the remaining provisions will be unaffected.

13. Limitation of liability

  1. Except as required by applicable law, NODI shall not be liable for any loss or damage incurred by you or any third party, unless such loss or damage directly results from the goods or services provided by NODI. In no event shall NODI be liable for any indirect, incidental, special, or consequential losses or damages, including but not limited to loss of profits, business interruption, or loss of data, arising out of or in connection with the goods or services provided.
  2. Nothing in this agreement shall limit or exclude NODI’s liability in circumstances where such liability is mandated by applicable consumer protection laws.

14. Ownership: Title to the goods will pass to you only on receipt by NODI of payment in full of all sums due to NODI, and until then, NODI has a security interest in the goods and may register that interest under the Personal Property Securities Act 1999. If the goods are attached, fixed or incorporated into any property of yours by way of any manufacturing or assembly process by you or any third party, title to the goods will remain with NODI until payment has been received by NODI in full, and where the goods have been mixed with other property so as to be part of a constituent of any new goods, title to the new goods is deemed to be assigned to NODI as security for the full sums owed by you. You hereby give NODI an irrevocable authority to enter any premises occupied by you or on which the goods are situated at any reasonable time after default (or before such default if NODI reasonably believes that default is likely) and to remove and repossess any goods and any other property to which goods are attached or into which goods are incorporated. NODI will not be liable for any costs, damages, expenses, or losses incurred by you or any third party as a result of this action. NODI may resell the goods and credit your account with the proceeds of sale (after deduction of all costs incurred in connection with such repossession and reselling) or may retain any repossessed goods and credit your account with the then value thereof (after deduction of all costs incurred in connection with such repossession). 

15. Grant of Security Interest: If payment is not made in advance for any reason, you agree that, as security for any and all obligations you owe to us, we may register a security interest over any goods supplied to you in accordance with the Personal Property Securities Act 1999 (PPSA).

16. Governing Law: This agreement shall be governed by and construed in accordance with the laws of New Zealand. Any dispute arising under or in connection with this agreement shall be subject to the exclusive jurisdiction of the courts of New Zealand.

17. Privacy: You authorise us to collect, retain and use any information about you for the purpose of assessing your creditworthiness, enforcing these terms, or marketing products to you. In that regard, you authorise us to disclose any information we have collected about you to third parties for these purposes, and these terms constitute your authority or consent in terms of the Privacy Act 2020. 

18. Marketing and Communication: NODI sends occasional emails to inform customers of new products and sales. Please advise your sales representative or email hello@nodi.co.nz   if you do not wish to receive future communication from NODI. You may also unsubscribe at any time directly from emails received.

Additional Charges Schedule

The customer agrees that the following additional charges may be applied -

Charge Amount Scope
Moving of furniture $150 per room Where moving of furniture is required but has not been included in the quote.
A room has five or less pieces of furniture, but does not cover antiques,TVs, computers, pianos, and safes. Customers must remove all clutter i.e., small items and clothing.
Installation Rescheduling $300 per date change Any job rescheduled by the client inside three working days prior to agreed install date for Auckland sites and 10 days prior for all outside of Auckland installations.
Storage Fee $36.50 per week per carpet roll Applicable where the agreed dispatch date is delayed. Nodi will hold your order for up to four weeks from the original agreed Dispatch Date outlined on your sales order). After this, charges will apply and will be nvoiced monthly until the order dispatches from the NODI warehouse.
Restocking fee 25% of original order Any excess carpet stock wanting to be returned for a credit, this value excludes any faulty products.
